Basement Apartments, Converted Garages, and Backyard Cottages Just Got Easier to Build Under New Maryland Law
Maryland homeowners may soon have more flexibility to build small secondary homes on their properties, creating opportunities for rental income and additional living space for family members. The units, known as accessory dwelling units (ADUs), can include basement apartments, converted garages or separate backyard cottages.
Under the new law, local governments must allow ADUs on properties with existing single-family detached homes, subject to applicable requirements. The changes also limit certain zoning restrictions, including some density limits and setback rules, that could otherwise make these projects more difficult.
For homeowners, the benefits could include renting out a small apartment, providing a separate home for aging parents or adult children, or making better use of their property. ADUs could also add housing options without requiring the construction of entirely new neighborhoods.
The law does not eliminate all restrictions. Homeowners must still meet applicable building and safety codes, obtain permits and comply with relevant local requirements. Construction costs, utility connections and property limitations may also affect whether a project is practical.
Prince George’s County has adopted an ordinance scheduled to take effect November 16, while Montgomery County already allows ADUs under its own zoning and permitting rules. Homeowners should check with their local government before beginning construction.
