Trump Fires Back at Supreme Court After Ruling Against Tariffs, Plans Roundabout Way to Impose Rules

Feb 20, 2026·3 min read

President Donald Trump issued an extended and fiery response on social media following the Supreme Court’s decision striking down his use of emergency tariff powers, calling the ruling “deeply disappointing” and accusing several justices of lacking courage.

Trump opened his statement by blasting the court’s majority:

“The Supreme Court’s Ruling on TARIFFS is deeply disappointing! I am ashamed of certain Members of the Court for not having the Courage to do what is right for our Country.”

He argued that the justices who voted against him were either politically motivated or intimidated, writing:

“Others think they’re being ‘politically correct’… they’re just FOOLS and ‘LAPDOGS’ for the RINOS and Radical Left Democrats… very unpatriotic, and disloyal to the Constitution.”

He went even further, suggesting outside influence on the majority:

“It is my opinion that the Court has been swayed by Foreign Interests, and a Political Movement that is far smaller than people would think. But obnoxious, ignorant, and loud!”

Trump reserved praise for the three conservative justices who dissented:

“I would like to thank and congratulate Justices Thomas, Alito, and Kavanaugh for your Strength, Wisdom, and Love of our Country.”

He urged supporters to read the minority’s reasoning:

“When you read the dissenting opinions, there is no way that anyone can argue against them.”

He later quoted Justice Brett Kavanaugh’s dissent at length, highlighting that multiple other statutes – Sections 232, 122, 201, 301, and Section 338 of the Tariff Act – may still allow a president to impose duties.

Trump framed tariffs as both an economic and national security tool, proclaiming:

“This was an important case to me, more as a symbol of Economic and National Security, than anything else.”
He argued the decision paradoxically strengthened presidential trade powers:

“The Supreme Court’s decision today made a President’s ability to both regulate Trade, and impose TARIFFS, more powerful and crystal clear, rather than less.”

“I have very effectively utilized TARIFFS over the past year to, MAKE AMERICA GREAT AGAIN.”

“Our Stock Market has just recently broken the 50,000 mark on the DOW and… 7,000 on the S&P.”

He also claimed tariffs helped end wars and cut fentanyl inflows by 30%.

Trump ridiculed the legal logic of the ruling:

“The Court said that I’m not allowed to charge even $1 DOLLAR to any Country under IEEPA… but I am allowed to cut off any and all Trade… even imposing a… destroying embargo… How nonsensical is that?”

“They are saying that I have the absolute right to license, but not the right to charge a license fee. What license has ever been issued without the right to charge a fee?”

Despite the setback, Trump vowed to move aggressively using other authorities. He emphasized:

“All National Security TARIFFS, Section 232 and existing Section 301 TARIFFS, remain in place.”

He then announced a new across-the-board measure:

“Today I will sign an Order to impose a 10% GLOBAL TARIFF, under Section 122, over and above our normal TARIFFS already being charged.”

He added that his administration is initiating new Section 301 and other investigations to counter what he described as unfair trade practices.
