Dan Sohail, the man authorities allege repeatedly rammed his vehicle into the Chabad-Lubavitch World Headquarters on January 28, is now facing federal prosecution.
Footage from the scene shows Sohail exiting his vehicle and shouting at bystanders, “I dunno, it slipped!” as a crowd gathered. He also appeared to spit in their direction while officers from the New York City Police Department escorted him to a patrol car.
The incident occurred as thousands of Lubavitchers from across the globe were assembled at the headquarters to mark the 75th yahrtzeit of the Lubavitcher Rebbe, the Rayatz zt”l, and the subsequent appointment of Harav Menachem Mendel Schneerson zt”l as his replacement.
Before the federal case, Sohail had already been charged at the state level with hate crimes. He remains jailed after being unable to meet bail requirements.
Details about the specific federal counts have not yet been disclosed. Although a federal magistrate judge has directed that the criminal complaint be made public, the filing has not appeared on the docket.
Authorities have expressed ongoing concern about isolated individuals carrying out attacks in the wake of U.S. military action overseas, including strikes targeting Iran.
“There could be retaliation from these efforts and not just on the fields in Iran and the Middle East,” New York Gov. Kathy Hochul said Monday. “We have a very vulnerable target in New York City. We’ve known that for a long time. But also, there could be lone actors, the details are coming out about the mass shooting in Austin, Texas for example.”
Hochul emphasized that the state is committed to protecting both Jewish and Iranian communities.
“We will not tolerate any hate or retaliation against anyone who calls New York home because of what’s happening,” the governor said. “Americans are tired of wars and they do not see how this keeps them safer.”
